Terms of Service Agreement for Affect Beard Care, LLC. & the event barber
Effective Date: June 8th 2024
1. Acceptance of Terms
By booking an appointment or receiving services at the Affect Beard Care, LLC. & the event barber, you (“Client”) agree to these Terms of Service (“Agreement”). If you do not agree with any part of this Agreement, please do not use our services.
2. Services
Affect Beard Care, LLC. & the event barber provides haircuts, beard trims, and other grooming services on a temporary, pop-up basis. All services are provided by professional barbers with appropriate training and experience.
3. Liability Waiver
3.1 Assumption of Risk:
Client acknowledges that the services provided involve the use of sharp instruments, electrical equipment, and other tools that carry inherent risks. By receiving services at the event, Client voluntarily assumes all risks related to the services provided, including but not limited to cuts, nicks, burns, allergic reactions, and other injuries.
3.2 Release of Liability:
To the fullest extent permitted by law, Client releases and holds harmless Affect Beard Care, LLC. & the event barber, its employees, contractors, agents, and barbers (“Released Parties”) from any and all liability, claims, demands, damages, or causes of action arising out of or related to the services provided, including but not limited to personal injury, property damage, or other losses.
3.3 Indemnification:
Client agrees to indemnify and defend the Released Parties against any claims or legal actions arising out of or related to the services provided, including reasonable attorney’s fees and costs.
4. Client Responsibilities
4.1 Accurate Information:
Client agrees to provide accurate and complete information regarding any allergies, sensitivities, or other medical conditions that may affect the services provided.
4.2 Compliance with Instructions:
Client agrees to follow all instructions provided by the barber before, during, and after the service to ensure their own safety and the safety of others.
5. Marketing and Use of Information
5.1 Consent to Use of Personal Information:
Client consents to the collection, use, and storage of their personal information, including but not limited to name, contact information, and service history, by Affect Beard Care, LLC. & the event barber for marketing and promotional purposes. This may include email newsletters, special offers, and other communications.
5.2 Photographs and Media:
Client agrees that Affect Beard Care, LLC. & the event barber may take photographs or videos during their visit for marketing and promotional purposes. Client grants Affect Beard Care, LLC. & the event barber a perpetual, worldwide, royalty-free license to use, reproduce, distribute, and publicly display these images and videos in any medium or format.
5.3 Opt-Out:
Client may opt out of receiving marketing communications at any time by following the instructions provided in such communications or by contacting Affect Beard Care, LLC. directly.
6. Changes to the Agreement
Affect Beard Care, LLC. & the event barber reserves the right to modify or update this Agreement at any time without prior notice. Any changes will be effective immediately upon posting the revised Agreement at the event or on our website. Client’s continued use of the services constitutes acceptance of the revised Agreement.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law principles.
8. Severability
If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
9. Entire Agreement
This Agreement constitutes the entire agreement between the Client and Affect Beard Care, LLC. & the event barber regarding the services provided and supersedes all prior or contemporaneous agreements, understandings, or representations.
By booking an appointment or receiving services, you acknowledge that you have read, understood, and agree to these Terms of Service.
